DRAFT — PENDING ATTORNEY REVIEW

In short. These terms cover using this website and talking to us. The moment you actually buy something, a separate Service Agreement and Order Form take over — and those are the documents that govern the work.

Like everything else we write, this is meant to be read. If anything is unclear, ask before you commit.

1. Who we are

ZEEKY (PTY) LTD ("Zeeky", "we", "us"), registration number 2026/577853/07, a company registered in South Africa. We design websites and run marketing for small businesses.

WhatsApp / phone: 065 780 1430
Website: zeeky.co.za

2. What these terms cover — and what they don't

These terms apply when you browse zeeky.co.za, send us an enquiry, or message us.

They are not the contract for our work. When you buy a package or a monthly plan, you sign an Order Form, and our Service Agreement (master terms) applies. Those set out what we deliver, what it costs, the guarantee, who owns what, and how either of us can end the arrangement.

If anything in these website terms conflicts with the Service Agreement or your Order Form, the Service Agreement and Order Form win.

3. Using this website

You may use this site to learn about us and get in touch. You may not:

4. Our content

The design, text, images, the Zeeky name and the Zeeky character are ours (or licensed to us) and are protected by copyright and trade mark law. Nothing on this site transfers any of those rights to you.

Work we produce for you is dealt with separately and generously in the Service Agreement: your domain is registered in your name from day one, and on final payment the site we build is yours.

5. Prices shown on this site

We publish our prices, on purpose — most agencies don't. Those prices are current at the time of publication and may change. The price that binds us is the one on your signed Order Form.

Zeeky is not currently a VAT vendor and prices carry no VAT. If we register for VAT, VAT will be added to invoices from the registration date, as the law requires.

Advertising spend is never ours to hold. Google and Meta bill your own card directly. We manage the campaigns; we don't route or mark up your ad money.

6. Enquiries, WhatsApp and how we contact you

When you contact us — through the site, by email, or on WhatsApp — we use your details to reply and to quote for the work you asked about.

7. What we don't promise

We cannot promise a specific Google ranking, a number of enquiries, or a sales figure — nobody honestly can, and you should be wary of anyone who does. What we do promise is written into the Service Agreement, including the "on the map in 14 days or your money back" guarantee on the Starter package.

Information on this site is provided in good faith and for general guidance. It is not professional advice for your particular situation.

8. Other people's platforms and websites

We link to third-party sites and we work on platforms — Google, Meta, hosting providers — that we don't control. Their decisions (ad rejections, account reviews, algorithm changes, outages) are theirs, not ours. We will always work around them as far as the platform allows, but we are not responsible for them.

9. Availability

We aim to keep this site available, but we don't guarantee uninterrupted access. We may change, suspend or withdraw any part of it, and we may update these terms as our services change.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential loss — lost profits, lost data caused by third parties, or business interruption — arising from your use of this website.

Where we are doing paid work for you, liability is dealt with in the Service Agreement, which caps our total liability at the fees you paid in the 3 months before a claim arose (or, for once-off packages, the package price).

Nothing here limits liability that the law does not permit us to limit, and nothing affects your rights under the Consumer Protection Act where it applies to you.

11. Privacy

How we handle personal information is set out in our Privacy Policy, which complies with the Protection of Personal Information Act 4 of 2013. To have your information deleted, see how to delete your data.

12. Changes to these terms

We may update these terms. The version number and date at the top show when they last changed. Continuing to use the site after a change means you accept the updated terms. Changes to a signed Service Agreement require both parties to agree in writing, as that agreement provides.

13. Law and disputes

South African law applies, and the South African courts have jurisdiction. We would always rather talk first — a phone call resolves most things — and we will engage in good faith before anyone goes near a court.
